This e-form waiver states that you are taking full responsibility for any personal injury to you and/or to others and any damage to the ride ons that may occur during your ride, but most importantly, for having a good time.

I hereby acknowledge that by filling this e-form (rider release), I am assuming all risk in riding a motorised amusement ride. For myself, executors, representatives, and beneficiaries in interest, I hereby agree to indemnify and hold harmless and irrevocably release to Zone Out Arcade, and its members, directors, managers, officers, employees, consultants, agents, representatives, volunteers and affiliates (collectively, the “rider release”), from and against all liability, including any personal injury to me or to others, any damage caused to or by any scooter/bike, and/or any negligence of Zone Out Arcade or me, arising from or related to, directly or indirectly, my ride or other use of the motorised amusement ride.

What am I agreeing to?

I hereby agree irrevocably to waive all claims arising from or related to my ride or other use of the amusement ride, and to bear all cost and expenses incurred by Zone Out Arcade, (including attorneys’ fees) in defending any such suit or other action or in the enforcement of this Release. I hereby understand and acknowledge that this Release is a contract with legal and binding consequences and that I am therefore giving up substantial legal rights.

I have read this e-form carefully before filling it, and I fully understand what it means and what I am agreeing to. I hereby acknowledge that riding any vehicle is inherently dangerous and fully realize the dangers of test riding any electric scooter/bike, particularly when test riding for the first time.

What are the risks involved?

I fully assume the risk associated with such  ride, including, by way of example only, (i) the dangers of collision with pedestrians and fixed and moving objects; (ii) the dangers arising from surface hazards (including curbs, sudden changes in surface elevation, slick or wet surface, and potholes), equipment failure, inadequate safety equipment, negligence and weather conditions; and (iii) the possibility of serious physical and/or mental trauma, injury, or death associated with the activity of riding a scooter/bike.

What am I taking responsibility for?

I hereby agree that it is my sole responsibility to ride an amusement ride so as not to endanger either myself or others. I hereby accept full responsibility for the condition and adequacy of the ride vehicle and my conduct, and agree to cease immediately riding the ride vehicle if any problems should arise from its operation. I have no physical or mental condition which would endanger myself nor others, or would interfere in any way with my ability to use a scooter/bike. I hereby agree that I am responsible for signing on behalf of any person under 18 years old in my care. 

I understand that any unacceptable, reckless or dangerous behaviour while riding will result in being removed from the ride immediately with no refund. 

I understand the boundary lines instructed by staff member and will respect them during the ride time. I understand I may be removed from ride if boundary lines are not followed appropriately.

This e-form may not be modified orally and a waiver or modification of any provision shall not be construed as a waiver or modification of any other provision herein or as a consent to any subsequent waiver or modification. Every term and provision of this e-form is intended to be severable. If any are found to be unenforceable or invalid, that shall not affect the terms and provisions, which shall remain binding and enforceable.
